Please read these Terms of Service ("Terms") carefully before using theprinthive.io (the "Site") or any related services (collectively, the "Service") operated by PrintHive ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
By creating an account or using the Service in any way, you represent that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them, along with our Privacy Policy. If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
PrintHive is an online marketplace that connects customers seeking 3D printing services ("Customers") with independent 3D print shop operators ("Shop Owners"). PrintHive provides the platform, payment infrastructure, and matching tools that facilitate these transactions. PrintHive is not itself a 3D print service provider and does not take responsibility for the quality of prints produced by Shop Owners, except as expressly described in these Terms. All transactions on the platform are between Customers and Shop Owners directly.
To use most features of the Service, you must create an account. You agree to provide accurate, complete, and current information during registration and to keep that information up to date.
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@theprinthive.io if you suspect any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period, with reasonable notice where required by applicable law.
When a Customer places an order, the full order amount (including any applicable taxes and shipping costs quoted by the Shop Owner) is charged to the Customer's payment method and held in escrow by PrintHive's payment processor (Stripe).
Platform fee: PrintHive charges Shop Owners a platform fee of 10% of the order subtotal for each completed transaction. This fee is deducted automatically at the time of payout. There are no monthly subscription fees and no upfront costs for Shop Owners.
Escrow funds are released to the Shop Owner within 1–2 business days after the Customer confirms receipt of the completed order. If the Customer does not confirm or dispute the order within 7 days of the recorded delivery date, funds are released automatically.
All prices on the Service are denominated in US dollars unless otherwise stated.
By registering as a Shop Owner, you agree to:
As a Customer, you agree to:
You retain all ownership rights to 3D model files you upload to the Service. By uploading files, you grant PrintHive a limited, non-exclusive license to store, process, and transmit those files solely to facilitate the fulfillment of your order. You represent and warrant that you have the right to upload the files and that doing so does not infringe any third-party intellectual property rights. PrintHive does not claim ownership of user-uploaded content and will not share your model files with parties other than the Shop Owner you select for your order.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PRINTHIVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNTS PAID BY YOU TO PRINTHIVE IN THE TWELVE MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR EXCLUSION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
If a dispute arises between a Customer and a Shop Owner regarding an order, we encourage both parties to first attempt to resolve it through the in-platform messaging system. If a resolution cannot be reached, either party may open a formal dispute through the PrintHive dispute resolution process. PrintHive will review the evidence and issue a binding determination regarding the release of escrowed funds.
Any disputes between you and PrintHive arising out of these Terms or the Service shall be resolved by binding arbitration administered under the rules of the American Arbitration Association, except that either party may seek emergency injunctive relief in a court of competent jurisdiction.
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
